1. Acceptance of Terms
By accessing or using the HostelDesk platform (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must immediately discontinue use of our services.
These terms constitute a legally binding agreement between you and HostelDesk regarding your use of the platform.
2. Service Scope
HostelDesk provides a digital management system designed to streamline hostel operations. We act as a software service provider and do not manage, own, or operate the physical premises of any hostel listed on our platform.
Any agreement regarding residency, rules of conduct within a hostel, or physical maintenance is strictly between the user and the respective Hostel Management.
3. User Responsibilities
As a user of HostelDesk, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized use.
- Refrain from using the platform for any unlawful, fraudulent, or malicious activities.
- Respect the privacy and data of other users within the platform.
4. Fee Payments
HostelDesk facilitates the tracking and recording of fee payments. However, actual financial transactions (rent, deposits, mess fees) are handled directly between you and the Hostel Owner.
HostelDesk is not liable for disputes arising from rent amounts, security deposit returns, or room allocations.
Payment Verification Responsibility: HostelDesk only facilitates the tracking of payment proofs. Hostel Administrators are 100% responsible for verifying their bank accounts/UPI to ensure funds are received before approving any payment records. HostelDesk is not liable for fake receipts or financial discrepancies.
5. Intellectual Property
All content on the HostelDesk platform, including but not limited to software code, design elements, logos, and trademarks, is the exclusive property of HostelDesk. You may not reproduce, distribute, or create derivative works without prior written consent.
6. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
7. Limitation of Liability
To the maximum extent permitted by law, HostelDesk shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the platform, including but not limited to loss of data, service interruptions, or disputes with third parties.
Operational Downtime: HostelDesk provides the Service on an 'as-is' basis. We are not responsible for any operational disruptions, security breaches, or unauthorized student leaves that occur during system outages or database downtime.
8. Hostel Administrator Data Compliance & Responsibility
If you register a hostel on our platform or use an Administrator/Warden account:
- Role & Consent: You act as the sole "Data Controller" for the resident data you enter. You warrant that you have obtained explicit consent from students (or their guardians) before uploading their personal details, phone numbers, emails, or verification documents to HostelDesk.
- Compliance with Laws: You are fully responsible for ensuring that your collection, storage, use, and sharing of resident records comply with all local privacy regulations (including but not limited to the Digital Personal Data Protection Act of India).
- Data Misuse: HostelDesk is not responsible for any misuse, unauthorized sharing, or leakage of student data caused by Hostel Administrators downloading, sharing, or mismanaging files accessed through the platform.
- Indemnification: You agree to defend, indemnify, and hold harmless HostelDesk (and DBRP Grow) from any legal claims, liabilities, damages, or fines arising from your violation of resident privacy or misuse of data collected on the Service.
9. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India (or your registered city).
